HYLA Diag Mobile Application Privacy Policy
This is the HYLA Diag Mobile Application privacy policy (“Privacy Policy”). This Privacy Policy will explain how Hyla, Inc. (“HYLA Mobile” or “we” or “our” or “us”) will use information that you share with us through your use of the HYLA Diag Mobile Application (“App”); what information we collection; and what we do with that information.
If you do not agree with the terms of this Privacy Policy, do not download App and do not use App.

The Information We Collect
All the information we collect is related to App’s functionality and/or features including:
- information we must have for you to be able to use App;
- information that will improve your experience with App (if you elect to share such information); and
- information we can use to provide additional App features (if you elect to share such information).
Required Information.
The information we must have for you to use App includes the following:
- International Mobile Equipment Identity (IMEI) number of your mobile device which enables us to identify your device to provide a more accurate price offer for your device.
Please understand that this information must be provided in order for you to use App. By agreeing to this Privacy Policy, you give us the right to collect this information and use it for the purposes described above.
Optional Information.
The information that will improve your experience with App —that we never receive unless you expressly choose to share it with us— includes the following:
- Your specific geo-location: We will never gather or use your specific mobile device location without getting your prior, explicit permission. We will gather this information using GPS or Bluetooth technology. This geo-location information enables us to tell you what retail stores are closest to you in proximity if you choose to trade-in your mobile device.
- Photos – you will be instructed to take a picture during the App mobile device assessment so App can better determine if your mobile device’s front and back cameras are operating properly. We will only access those images you specifically take during the App mobile device assessment. We will never store, scan, or import those photos.
Again, the information in this Optional Information group, is information we will only collect if you explicitly give us permission to do so in the future—within App. We will ask for your permission prior to accessing it, we will describe how we will use it (if you give us permission), we will only use the information for the purpose(s) we described, and you will always have the ability to change your mind and revoke that permission. By accepting this Privacy Policy, you have not granted us permission to access or to use such Optional Information. Within App, you will be asked to grant that permission.
We will not be sharing the Required Information or Optional Information described above with any third-parties.
We do not use cookies within App.
Usage
When you use App, we may use a variety of technologies that collect information about how App is used. This information may include:
- information about your interaction with App;
- details about any questions you may ask or requests you may make of us regarding App (such as, the date and time of such submitted questions/requests);
- technical data, which may include, without limitation, version of App application, IMEIs, the types of device you are using with App, device attributes, provider and device performance, operating system.
We may use the information we collect (with your permission), including your personal information:
- to ensure App’s technical functionality; develop new features, products and/or services; and analyze your use of App (including your interaction with applications or websites linked);
- to communicate with you for App service-related purposes including via notifications, which you agree to receive;
- to enforce this Privacy Policy, the App Mobile Terms and Conditions, and any other terms that you have agreed to,
- to protect our rights or property, other person’s rights or property, or any copyright-protected content of App;
- to provide you with information which is influenced by your location; and
- as otherwise provided in this Privacy Policy.
Information We Share
We will only disclose personal information to other companies within our group of companies, business partners, government bodies and law enforcement agencies, successors in title to our business and suppliers we engage to process data on our behalf. In these limited circumstances we will only share your personal information for legitimate business purposes and to comply with legal obligations. We may also share your information with third parties for these limited purposes:
- to respond to legal process (e.g., a court order or subpoena), if, in our discretion, we believe in good faith that doing so is necessary to: comply with applicable law requirements; to protect the safety of any person(s); to protect our property; to protect our rights; to address fraud, technical, or security issues; to enforce the App Mobile Terms and Conditions or any other terms that you have agreed to; and to address fraud, security, or technical issues;
- to publish de-identified and/or aggregate information about the use of App; and
- to allow a merger, acquisition, or sale of all or a portion of our assets.
We may from time to time share your information with third-party service suppliers to perform functions and/or process user data, consistent with this Privacy Policy. Any such third parties are/will be made subject to security and confidentiality obligations consistent with this Privacy Policy and applicable law. If any third party processes user data on its own behalf, its processing is subject to its own privacy policy and applicable law.
Links to Other Websites
App may contain hyperlinks to third-party websites which are outside our control and are not covered by this Privacy Policy. If you access other sites using the links provided, the operators of those sites may collect information from you which will be used by them in accordance with their privacy policy, which may differ from this Privacy Policy. We cannot be held responsible for third parties’ privacy practices and content. Please read their privacy policies to find out how they collect and process your personal information.
Security
We maintain safeguards to protect any personal information you provide to us through App against unauthorized disclosure, use, alteration, or destruction. Please note, however, that perfect security does not exist on the Internet. Therefore, while we endeavor to protect your information, when data is transferred over the Internet it may potentially be accessed and used by unauthorized parties. We do not guarantee the security of user information.
Internet-based Transfers
Given that the Internet is a global environment, using the Internet to collect and process personal information necessarily involves the transmission of data on an international basis. Therefore, by using the App and communicating electronically with us, you acknowledge personal information in this way. However, we will endeavor to protect all personal information collected through this application in accordance with strict data protection standards. Information we collect may be transferred to, stored and processed in the USA and in any other country or territory where one or more of our affiliated group companies or third party service providers are located or maintain facilities. While other territories may not have the same standards of data protection as those within your home country, we will continue to protect the personal information we transfer in accordance with this Privacy Policy. Hyla has entered into data transfer agreements (based on the EU model clauses for transfers of personal data outside the EEA) with its group affiliates and third-party providers located outside the EEA to whom it may transfer the personal information.
Access Rights
Subject to applicable local law, we will provide users with access to their data and, when appropriate, allow them to request that their personal information be corrected, updated, blocked or deleted where it is inaccurate, outdated or obsolete. App users may exercise their right of access by contacting us as stated below. App users may also object to the processing of their personal information, based on legitimate grounds, and in accordance with applicable local laws. In some circumstances, objecting to our use of personal information may prevent us from providing services through App to those users and/or from maintaining a relationship with such users.
Children under 13
App is not directed towards and is not intended for users under the age of 13. We do not knowingly collect any personal information from children under 13. If we become aware that a person submitting information is under 13, we will attempt to delete the information as soon as possible. You hereby represent that you are at least 13 or older. If you are under the age of 13, do not use App and do not provide any personal information to us. Updates to this Policy
From time to time we may update this Privacy Policy. When we do, we will publish the changes in App. If you do not agree with these changes, please do not continue to use App. If material changes are made to this Privacy Policy, we will notify you by placing a prominent notice in App.
